In a recent post we discussed the Digital Millennium Copyright Act and its importance in protecting copyrighted material on the Internet. Homepreneurs has been a repeated victim of exactly this problem. An anonymous writer has re-posted our material and profited from it by selling advertising on his website. As you are aware, no money is made from this blog or any related social network concern. I was able to track down the alleged violator’s website host and file a formal DMCA complaint with their legal department.
According to their terms of service: In order to comply with US Federal Law for copyright infringement complaints, we require a takedown notice that conforms to the requirements of the Digital Millennium Copyright Act to be submitted. The requirements for this notice are listed in Section 11 of our Terms of Service, or you may also find a form to fill out online via a web search for “DMCA takedown form.”
Please submit a completed takedown form for the infringing material and we will be able to proceed with action against the account.
Under Federal law: …under 17 U.S.C. Section 101 et seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504(c)(2) therein.
Though multiple violations exist from the alleged party, I filed only one specific complaint and will report on the cooperation and results of the investigation by the web host’s legal department. I’ve done this not only because I’m angry about the violation, but also to help anyone else in similar circumstances. If you put copyrighted material on the Internet – in a blog, website or wiki – it is considered “owned” by you and may not be reprinted without permission. Wronged individuals have a right to recourse and potentially, monetary damages.
If you find yourself in a similar situation, please fill out the appropriate DMCA form and report it to the hosting provider. They have obligations under Federal law to investigate and take action, if warranted.
